On September 25, 2025, FDA published a final rule (90 FR 46045) amending the prior notice regulations. Under 21 CFR 1.281(b)(10), beginning October 1, 2026, prior notice submissions for food arriving by international mail are required to include:
- The name of the international mail service; and
- The mail tracking number.
The final rule also allows prior notice for food arriving by international mail to be submitted through the PNSI or the U.S. CBP ABI/ACE/ITDS (21 CFR 1.280(a)(2)).
Since publication of the final rule, FDA has become aware that additional time may be needed for submitters to use and the agencies to fully implement the system functionality that receives such information. Therefore, FDA does not expect industry to submit the international mail service name and mail tracking number until May 1, 2027.
