APCIA urges lawmakers to advance bills on litigation financing
The House Judiciary Committee has advanced the Protecting Our Courts from Foreign Manipulation Act, which would mandate disclosure of agreements with foreign third-party litigation financiers and prohibit foreign state-backed financing of US federal litigation. APCIA supports the bill and the Litigation Transparency Act of 2025, which is also under consideration by the committee. The two bills would "bring accountability to shadow groups who treat the court room as an investment product, instead of an impartial justice system," APCIA's Sam Whitfield said.

Insurer survey: Severe convective storms are biggest threat

A Demex-commissioned survey conducted largely among APCIA members found respondents citing severe convective storms as the peril that poses the greatest risk to their balance sheets. According to the survey, 87% of respondents said they were significantly or somewhat concerned about future losses from severe convective storms, outpacing concerns about losses from perils such as wildfire, hurricanes and flooding.

AI assisting cities, states in identifying road hazards
Municipalities and states across the US are increasingly using AI to enhance road safety and set priorities for repairs and improvements. Hawaii has introduced the "Eyes on the Road" campaign, through which it is distributing 1,000 AI-powered dashboard cameras to detect hazards such as damaged guardrails and road debris. Meanwhile, San Jose, Calif., has reported a 97% accuracy rate in pothole detection via cameras on street sweepers, and the city is now involving its parking-enforcement vehicles in the initiative.

Cloudflare: Outage was due to bug, not cyberattack
Cloudflare has confirmed that a global outage that affected services such as ChatGPT, Shopify and X was not caused by a cyberattack but by a bug in the bot mitigation system triggered by a routine configuration change. The incident affected New York City Emergency Management, New Jersey Transit and other critical organizations.

CIAB: Commercial property rates drop for first time since 2017
Commercial property insurance rates declined by 0.2% on average in the third quarter, marking their first drop since 2017, after average increases of 1.9% in Q2 of this year and 7.9% in Q3 of last year, according to The Council of Insurance Agents & Brokers. Overall rate increases for commercial insurance averaged 1.6% in Q3, down from 3.7% in Q2, CIAB says.

S&P: Surge in asbestos losses raises reserve concerns
Net incurred asbestos losses and loss adjustment expenses for the US property casualty insurance sector jumped 29% in 2024, reaching $1.29 billion, compared with $986.2 million the prior year, according to S&P Global Market Intelligence. This surge is prompting industry concerns about litigation and the adequacy of reserves, as it "suggests that the 'tail' on ... decades-old policies may be longer than many carriers anticipated," S&P says.

Companies fill gaps in East Coast flood-risk data
Companies such as Natrx and Fathom are stepping in to address gaps in flood-risk data, particularly as the Atlantic Ocean increasingly threatens coastal properties. Natrx is working with the North Carolina Coastal Federation to analyze the state's coastline using AI and remote sensing, while Fathom is providing data to Virginia for a flood protection master plan. These efforts are aimed at offering more contemporary and comprehensive data than what the Federal Emergency Management Agency traditionally provides.

Pair of storm systems may affect Thanksgiving travel
Two storm systems might affect travel during Thanksgiving week, potentially causing delays as nearly 82 million people will be driving, flying or traveling by rail. The first system is forecast to bring rain to the southern Plains, Southeast, and possibly the mid-Atlantic and Northeast starting Monday. The second system is forecast to generate rain and colder conditions in the Pacific Northwest and areas between Missouri and Texas, with the possibility of snow where colder air prevails.
