Today, the Wage and Hour Division (WHD) published two opinion letters. These letters address section 3(m)(2)(B) of the Fair Labor Standards Act (FLSA) and Family Medical Leave Act (FMLA) regulations.

FLSA2025-1 - Whether a manager or supervisor under section 3(m)(2)(B) of the FLSA can receive tips from a tip pool when working in a non-supervisory capacity.

FMLA2025-1-A - Whether the Family and Medical Leave Act regulations pertaining to substitution of paid leave apply when employees take leave under state or local paid family leave programs.
